SAF Case Challenges Illinois’ Application of Criminal Statutes Already Ruled Unconstitutional

Mr. Harper was charged with various crimes for carrying a pistol in Illinois.  After he was charged, both the Illinois Supreme Court and the United States Court of Appeals for the Seventh Circuit ruled that carry was protected by the Second Amendment.  Nonetheless, Mr. Harper was still facing potential felony prosecution under these unconstitutional laws and he sued, asking the court to order the state to not prosecute.  SAF has taken over this matter on appeal and it is currently pending before the Seventh Circuit.
