SAF Files Texas Lawsuit Defending the Gun Rights of Citizens Living Abroad, Challenges 'Sporting Purpose' Restriction

The federal statutes being challenged ban the receipt, sale and purchase of firearms by U.S. citizens who claim legal residency outside the U.S. Expatriates cannot buy guns, and while they can receive guns for ‘lawful sporting purposes,’ they cannot do so for lawful self defense while visiting the U.S. The suit claims that these laws violate the Second and Fifth Amendments to the U.S. Constitution.

SAF Sues to Overturn San Francisco Gun Ban

Breaking News: The city appealled SAF's intial victory overturning the San Francisco Gun Gun. The California Appeals Court has just unanimously ruled to uphold the lower court's decision, so SAF has won again. The city can now appeal to the California Supreme Court, but given the unanimous ruling, it is unlikely they will hear the case. The decision is available as the last item listed below.

BLOOMBERG OUTRAGE: ASKS JUDGE TO BAN 2ND AMENDMENT REFERENCES!

May 9, 2008 - BELLEVUE, WA – New York Mayor Michael Bloomberg has moved from outrage to atrocity by asking anti-gun activist federal Judge Jack B. Weinstein to ban any reference to the Second Amendment during a civil lawsuit trial beginning May 27 against Georgia gun dealer Jay Wallace, proprietor at Adventure Outdoors. The New York Sun reported that Bloomberg’s attorneys made the request. (Read More...)

SAF CHEERS FEDERAL COURT REJECTION OF BLOOMBERG LAWSUIT

April 30, 2008 - BELLEVUE, WA – The Second Amendment Foundation said today’s dismissal of a lawsuit filed against the firearms industry by anti-gun New York Mayor Michael Bloomberg should send a clear message that “courthouse demagoguery and harassment of law-abiding business is not the responsible way to fight crime.” The 2-1 opinion, written by U.S. (Read More...)

SAF BLASTS ‘KILLADELPHIA’ MAYOR, COUNCIL OVER MEASURES DEFYING STATE LAW

April 11, 2008 - BELLEVUE, WA – Philadelphia Mayor Michael Nutter and the City Council have defied state statute by enacting several anti-gun measures, essentially “acting like urban vigilantes under color of law,” the Second Amendment Foundation said today. “How can Mayor Nutter and the council expect anyone else, especially criminals, to obey the law if they don’t live up to the same standard,” SAF founder Alan Gottlieb wondered. “Just because the mayor doesn’t like the fact that the state legislature retains sole authority over gun laws does not give him or the city council any right to essentially set up their own fiefdom. SAF HAILS CALIFORNIA HIGH COURT VICTORY OVER S.F. HANDGUN BAN

April 10, 2008 - BELLEVUE, WA – The California Supreme Court made the right decision in rejecting an appeal by the City of San Francisco that sought to uphold its handgun ban, the Second Amendment Foundation said. SAF was joined in a lawsuit against the handgun ban by the National Rifle Association, Law Enforcement Alliance of America, California Association of Firearms Retailers and San Francisco residents. The lawsuit was filed just days after voters in the city passed Proposition H in November 2005. (Read More...)

‘AMERICA HAS LOST A TRUE PATRIOT,’ SAYS SAF ABOUT DEATH OF CHARLTON HESTON

April 7, 2008 - BELLEVUE, WA – “With the passing of Charlton Heston over the weekend, America has lost a true patriot, and a man who stood up for all civil rights,” said Alan Gottlieb, founder of the Second Amendment Foundation. Gottlieb said the former National Rifle Association president and Academy Award-winning actor was a “pillar of strength” for the gun rights movement, and his passing is a sad event for the entire firearms community. “Mr. (Read More...)

INDIVIDUAL RIGHTS WON IN TODAY’S SUPREME COURT HEARING, SAYS SAF

March 18, 2008 - BELLEVUE, WA – Today’s oral arguments before the U.S. Supreme Court in the case of District of Columbia v Heller produced a clear victory for the individual citizen’s right to keep and bear arms, the Second Amendment Foundation said. (Read More...)

SAF SAYS D.C. RESIDENTIAL GUN SEARCH AN EXERCISE IN ‘POLICE STATE DEMAGOGUERY’

March 13, 2008 - BELLEVUE, WA – A plan to conduct “consent searches” for guns in District of Columbia residences is “an outrageous exercise of police state demagoguery,” the Second Amendment Foundation said today. SAF founder Alan Gottlieb condemned the plan as “a public relations effort designed to influence, through crass dramatics, Tuesday’s scheduled oral arguments on the constitutionality of the District’s handgun ban before the Supreme Court.” “Launching this effort,” he stated, “on the eve of Supreme Court arguments over the city’s horribly failed handgun ban underscores the Draconian mentality that lies at the root of gun laws like the District handgun ban. SAF FILES AMICUS BRIEF IN D.C. GUN BAN CASE BEFORE SUPREME COURT

February 13, 2008 - BELLEVUE, WA – The Second Amendment Foundation has filed an amicus curiae brief in District of Columbia v Heller, the appeal of the landmark case that overturned the district’s handgun ban on the grounds that it unconstitutionally violates the Second Amendment right to keep and bear arms. Written by attorney Nelson Lund at the George Mason University School of Law, the brief has already earned praise of veteran Second Amendment authority David Kopel, who noted in remarks on a popular Second Amendment website, “If you want to read a model Supreme Court brief, this is the brief to read.” In the brief, Lund notes that the Second Amendment right of the people to keep and bear arms would remain even if the militia were disbanded. DOJ BRIEF ON WASHINGTON, D.C. GUN RIGHTS CASE IGNORES DR. KING’S LESSON

January 21, 2008 - By Alan Gottlieb and Dave Workman

Martin Luther King put it best: “A right delayed is a right denied.”

The lesson appears to have been lost on the Department of Justice and Solicitor General Paul D. Clement in the amicus curiae brief submitted recently for the government in the case of District of Columbia v. (Read More...)
